Couple Sue McDonald's Over Tough Bagel
PANAMA CITY BEACH, Fla. -- A couple is suing the franchisee of a McDonald's restaurant, claiming an improperly prepared bagel damaged the husband's teeth and their marriage.

John and Cecelia O'Hare sued Friday for unspecified damages more than $15,000. They alleged the McDonald's, owned by Johnstone Foods Inc., was negligent and violated an "implied warranty that the food sold was reasonably fit for human consumption."

They contend in the suit that John O'Hare broke teeth and bridgework on Feb. 1, 2002 when he bit into the bagel. The suit did not say what exactly was wrong with the bagel.

The suit alleges the wife "lost the care, comfort, consortium and society of her husband." The couple's attorney, Tim Warner, did not return telephone messages left at his office.

Tracey Johnstone, owner of Johnstone Foods, said she never before had a bagel complaint and had no idea how it could have been prepared in a way that would damage teeth.

"It's a bagel," she said.

Or how stupid some people can get? My goodness. Maybe I should have sued the cafeteria when I ate tacos and it popped the brackets off my braces when I had them? I'd be rich! :)

Lots of love,

Maybe I should sue the microwave pizza maker when their pizza burns the roof of my mouth. If only things worked that way.

so she's suing mcdonalds for her husband being a self-centred, whiny shite when he broke a few teeth? i'm sure that's their fault. :hang:

LOL....if they got a divorce because he lost teeth, I highly doubt it was a good and stable marriage to begin with. Morons...I should really sue paper mate for making a object I could accidentaly stabbed myself with, or paper companys when I get a paper cut...some people are just d0rks'.....*no pun intended...ok maybe it was*

Remember the fat people that were gonna sue mcdonalds because they said it was Mcdonald's fault that they were fat? That has to be one of the most retarded lawsuits ever.

Also, what is beyond me here is how damaged teeth can effect a marriage, unless they protrude so far he stabs her with them when they try to kiss...

"Stupid" lawsuits will always happen, no matter how many warning messages there are.
There was one guy who, after buying a new RV with cruise control, was driving down the highway. Getting thirsty and tired, he wanted some coffee, but since the rest of his family was sleeping, he decided to turn on the cruise control and get up and make some for himself. Needless to say, the RV crashed. He then proceeded to sue the company that manufactured the RV because they didn't explicitly mention that he should not get up while driving the RV. He won.

What if someone was in that car and the airbags didn't go off? There's another hazzard that the company will need to fix. I don't want people's lives in danger when I'm running from the cops after a murder...They're just as important as me...

In my home town, there was an old couple who tried to sue the local McDonald's for finding brown glass in their fries. Claiming that the heat lamp must have shattered over their fries and no one tried to clean it up. The case was laughed out of court when the judge was shown that the heat lamps used were made of clear glass.

duet maxwell
4th February 2003, 21:14
um then where did that brown glass come from?

anubis2003
4th February 2003, 21:20
They probably brought it in and claimed that it came from the heat lamps, but when they actually got it from their house. Many people have tryed to stage something to get money. I know someone who tried to break his leg on a trampoline because the warning label didn't say to not jump from an elevated platform(his house) onto the trampoline. Fortunately, he didn't break his leg, just made himself look like an idiot.

I was at a Mc Donald's...during the time the shuttle burned up in the Earth's Atmosphere. And I was eating a Sausage Biscuit Sandwich.

Also the thing, bagels are hard. DUH! Instead why not fix the teeth, and bite into an Einstein's Bagel..same damn thing. People can't be dumb, or at least he should brush his teeth if they fell out while eating food. Damn fool..get braces or dentures. :D Also whats with a marriage in a Mc Donalds? Cheap as heck people. :p

A frind of mine (who's really tall and strong) used to buy a BigMac, take a huge bite and them smash it with one hit from his fist, walk back up to the counter and claimed that he got it like that...the clerk didn't wan tot got into trouble with him and just gave him a new one so he got 1 1/2 bicmac for the price of 1 (works one time at one McDo or you have to wait until the workers change)

....didn't want to give you bad ideas just wanted to tell you that when being impudent enough (and having some king of authority) yo can get a lot of stuff like that, why not win a lawsuit that nobody has ever thought of? If the judge is really that stupid to let them win...nice extra spending money!

speaking of pulling scams at McD's, I once ordered a plain hamburger with no salt. Everytime I got the burger back, I could see that they sprinkled salt on the burger. I had to go back 4 times before I got one without salt! (Low sodiom diet)

i dont go to mcdonalds anymore
reason #1: 36% of the employees at mcdonalds in ontario canada admitted to putting some type of bodily fluid in the food
reason#2: the burgers are grey and 3 mm thick
