Does anyone know about whether or not you can use this to broadcast live video in it's current state? Do you have to have a capture card installed in order to do live encoding or what?

Well, you have to capture the audio/video from somewhere. So a capture device is kind of required for live streaming. You can use a single video file, but with the current public tools you cannot make a playlist and loop it.

I was also wondering if someone out there made a software capture driver that could pull video playing from a DirectShow filter (like when playing movies in windows media player) and send that to the NSV encoder, if I can't find one, i'll use the TV-out on my video card and plug that into my capture card. It's kind of like a screen capture driver, but I only want it capturing the video currently playing. My thoughts were that I could make a looping playlist of video files for it to play live.
I am really interested in what nullsoft uses for encoding playback on their stations, if justin is willing to divulge that information.... :)
