Hello all I want to broadcast for free, at 128 can anyone point me to the right direction

You need to download (http://www.shoutcast.com/download/) and install (http://www.shoutcast.com/support/docs/) the Shoutcast Server.

I have down that, it only allows 56 khz at 22 mhz i want to goto 128 44 i know you need a codec but the question is which and where can i grab it from

Have you read through the docs (http://www.shoutcast.com/support/docs/) yet?
Any way, the FAQ (http://www.shoutcast.com/support/docs/docs.phtml?filenumber=130&language=english&layout=normal&prevlayout=normal) section of the docs would tell you the free MP3 codec is limited to 56kbps. To go over that you need to buy a commercial codec from Fraunhofer (http://www.fhg.com/).
Or you may use the Oddcast DSP (http://www.oddsock.org/tools/dsp_oddcast/) instead of Shoutcast DSP. (Oddcast uses the LAME codec, developed independently and available as free software.) Be aware that it's still in beta, so things might break, go up in flames etc.

I don't know the shoutcast server, itself; so I don't guarantee this will be of any help to you.
But, you can get a commercial version of the Fraunhauffer (I hope I spelled that right) codec by installing the DivX video codec 3.11 alpha release. It includes the L3 codec, and the set-stereo utility which will enable mp3 encoding up to 360kbs.
There are probably quite a few links, but this is the only one I know off-hand:
*NOTE: You must allow the installer to over-write the existing L3CODECA.ACM file with it-s so-called "older version", or you will still be stuck with the lower bitrates. You must then run the set stereo applet to enable the codec.
