The following is correspondence between myself and "Disney" regarding my Cinderella skin. The skin will be deleted within 24 hours, or when Disney decides to contact AoL and have them remove it. Whichever comes first.

As a Disney fan, it saddens me to see such immediate disregard for Fan Art.
I understand completely regarding copywrite laws, however, I can not understand their placement in this issue. The reason being simply, I have done it for no other reason than to pay tribute, to a beautiful faerie tale, which I have loved all of my life. I have accepted no form of payment for the hours I spent creating this Skin, it has been offered only to decorate a persons Desktop and to promote your website/product.

I will remove the skin promptly, and I will pass your email along to the Winamp Forums. I will not republish this skin. I will, however, retain the right to create an alternate version of the same skin. Excluding all Disney images and all references to Disney itself, I do not believe that you particularly own the "fable" of the girl who was abused as such, and found her way by luck into fortune and fame.

I think that its a shame really. The free publicity which I gave Cinderella should more than make up for my choice in creating it in the first place. But since you feel the need to force legalities on me, I hereby request that Disney.com create their own sets of winamp skins, with their own images, by their own artists, so that the skinning community can enjoy them.

But I guess your corporation wouldn't bother with such a trivial thing. After all, no one will pay you for them.

They don't own Cindarella, the story. But they do own those pictures.

Amp, I asked myself the same thing. Here's the answer. I wanted the opportunity to remove it myself, by my own hand, before anyone else did. Or at least have notice that it was going to be taken down. Like the sport thing, I understand the legalities of it all, it just hurts my feelings, that as a fan, a paying fan, a thousands of dollars paying fan for that matter, they would just disregard it. It's not like I made money or anything.

Anywayz, the skin is there for about 24 hours. Not that I'm saying anyone should download it or anything... but if they want it... what can I do?? I'm too busy to do it right now :)
Hell it took her a week to answer me. I should wait a week. But I won't.

Lucid? That particular skin will not die in and of itself. The Disney logo, and the Disney images will be removed. ButI'm sure if I look hard enough, I can find some unknown artist willing to hook me up with their version of Cinderella. Or hell, I might just create my own. Use images of me and my friends or something :)

That doesn't make sense to me. If you hadn't emailed them, they would probably not have taken notice of the fact the skin exists...so it wouldn't have been deleted.

My best guess: I really don't think AOL is going to force NS to remove all copyrighted content from the DB. Just the sports-related skins...because they(AOL) prolly had a "take-it-down-or-I'll-sue-you" type of request from a specific team/company/league/organisation/whatever. Either that or they'll take the entire DB down. But like I said, I highly doubt all skins containig copyrighted material will be individually hunted down and killed

Oh well... :) happy thoughts

Amp? I'm disgustingly moral. What can I say? Yeah they may never have known, but maybe in my own ego I was hoping they'd say "Hey thats awesome! Thank you." or some other such disregarding type of nicety like "yeah whatever, get lost, we got no time for you, we have a huge corporation to run over here that doesn't even know or care that you exist".
In my defense, I really had more faith in Disney Corporation.

next time, after you've made a skin.... if you're gonna do something like this... say "hey, I'm Forever a freelance skin designer. Would you be interested in hiring me?" If the answer's yes (prolly not, but you never know :D ), sell it to them for big $$$. If not, just publish it here :D:D:D

what answer would you prefer ? In terms of law, the successors of the Grimm's brothers or their editor, publisher, whatever. In my personal view, they belong to all of us ... their intention was not $$$ but to teach the children

Here is the Mbinner file. Just add it to your zip. No images required. The only one I used is a blue star to trail the cursor and its linked directly to my ftp space (because of it having transparencies, requiring a gif format).

:mad: Sorry Forever, that really sucks.:mad: It makes me grateful for the good luck I've had with my potential copyright issues, like Joe Rogan and Bloom County. Seems like the only good thing that's gonna come out of the copyright mess is that it will really end up pushing the quality art skins to the front, and weed out alot of the no talent skinner skins. Thank god you can still do stuff like "Obsidian" without people jumping on you.

Duk, dont' worry too much about it. I don't think AoL/NS will bother deleting Disney skins until they actually hear from Disney.

However, on my word, at exactly 5:30pm today, I clicked the delete button.

I am no longer posting, or circulating the skin known as Walt Disney's Cinderella.

However, I can not be held accountable for the 6,632 people who have it :)

Thats 2,780 downloads since yesterday. You are all awesome.

that sucks!!! :mad: :( They can delete the whole db and close the site if they continue like this. I'm sure they're right about the copyright issue but I really don't understand why a skin is a problem... If you'd have a homepage with disney art you'll have to take it down too I suppose.







And my matrix skin would be a copyright violation too then, using the matrix symbols without WB permission... Hope no one will notice :rolleyes:

Disney has been notoriously fan un-friendly since the early 90's. You would think they'd enjoy the free publicity, but no, perish the thought that anyone outside of Disney do anything that uses their characters. :rolleyes:

Heck, even Lucas has lightened up about the fan sites and whatnot, and B5 even approved "Babylon Park".

But no, this is Disney. 'nuf said.

I remember that skin; while I'm not a huge Cinderella fan, Ithought it was a very well made skin. I'm sorry to see it go.

That would be "Song of the South", one of the few Disney movies that Disney will not release to video or DVD. They're ashamed of it because it's not "politically correct" anymore. :mad:
