Couple Sue McDonald's Over Tough Bagel
PANAMA CITY BEACH, Fla. -- A couple is suing the franchisee of a McDonald's restaurant, claiming an improperly prepared bagel damaged the husband's teeth and their marriage.

John and Cecelia O'Hare sued Friday for unspecified damages more than $15,000. They alleged the McDonald's, owned by Johnstone Foods Inc., was negligent and violated an "implied warranty that the food sold was reasonably fit for human consumption."

They contend in the suit that John O'Hare broke teeth and bridgework on Feb. 1, 2002 when he bit into the bagel. The suit did not say what exactly was wrong with the bagel.

The suit alleges the wife "lost the care, comfort, consortium and society of her husband." The couple's attorney, Tim Warner, did not return telephone messages left at his office.

Tracey Johnstone, owner of Johnstone Foods, said she never before had a bagel complaint and had no idea how it could have been prepared in a way that would damage teeth.

"It's a bagel," she said.

Also, what is beyond me here is how damaged teeth can effect a marriage, unless they protrude so far he stabs her with them when they try to kiss...

"Stupid" lawsuits will always happen, no matter how many warning messages there are.
There was one guy who, after buying a new RV with cruise control, was driving down the highway. Getting thirsty and tired, he wanted some coffee, but since the rest of his family was sleeping, he decided to turn on the cruise control and get up and make some for himself. Needless to say, the RV crashed. He then proceeded to sue the company that manufactured the RV because they didn't explicitly mention that he should not get up while driving the RV. He won.

ROFL. Thats just plain dumb. They also didnt say that it could drive itself did they? Come one. Some people just dont have brains. :rolleyes:

In my home town, there was an old couple who tried to sue the local McDonald's for finding brown glass in their fries. Claiming that the heat lamp must have shattered over their fries and no one tried to clean it up. The case was laughed out of court when the judge was shown that the heat lamps used were made of clear glass.

They probably brought it in and claimed that it came from the heat lamps, but when they actually got it from their house. Many people have tryed to stage something to get money. I know someone who tried to break his leg on a trampoline because the warning label didn't say to not jump from an elevated platform(his house) onto the trampoline. Fortunately, he didn't break his leg, just made himself look like an idiot.

They've had mc-bagels for a while. They aren't that great, and I'm not sure if they carry them at all mcdonalds or not.

He WON? That's just fucking sad. If that's the state our legal system is in these days, I seriously have no faith in it anymore. :eek:

I was at a Mc Donald's...during the time the shuttle burned up in the Earth's Atmosphere. And I was eating a Sausage Biscuit Sandwich.

Also the thing, bagels are hard. DUH! Instead why not fix the teeth, and bite into an Einstein's Bagel..same damn thing. People can't be dumb, or at least he should brush his teeth if they fell out while eating food. Damn fool..get braces or dentures. :D Also whats with a marriage in a Mc Donalds? Cheap as heck people. :p
