I need some advice on titling a car..

I bought an older car from person A a little over a month ago.. in Arkansas. He drove it down here, and it started having problems.. so he didn't want to drive it back to Oregon.

He said he'd mail me the title when he got it from the friend he got the car from. He proceeded to tell me later on that the friend wouldn't give him the title. The friend is person B.

I contacted person B after giving up on Person A. Person B, the owner that the car is STILL registered to, insists he gave person A the title to the car.

Person B said that he did in fact give person A the car, and that he didn't care it was sold to me.. but that he wouldn't request a new title for me, even if I paid the fees.. because he didn't want to deal with it.

What are my options here? The car is still currently (actively) registered in Oregon.

Person A was a douche, person B is alright.. but he really just doesn't want to mess with it anymore, I suppose.

Person B *and* Person A are Oregon residents. The car is registered in Oregon. The car is currently located in Arkansas (my parking lot, to be more specific), and that is the state in which I am a resident.

call the Oregon Department of Transportation and explain that the title has been lost. Give them the contact information for the last known owner of the vehicle (Person B). Be sure to have the VIN and license plate number of the vehicle handy when you call.

They should be able to straighten things out.

^what GG said.

protegechris 28th August 2008 10:52

So should I explain the whole "title never transferred" situation to them? Or just that it has been lost?

swingdjted 29th August 2008 05:36

Just read to them what you typed to us, except with real names where Person A & B were.

protegechris 29th August 2008 12:11

Well, since person A never registered the car in his name, I cut him out of the scenario. Person B is going to give me a bill of sale from him to me (and then promptly said he didn't want to hear about the car again ahah).

Oregon DOT says I can request a replacement title be sent directly to me, without so much as the current owner's signature, if I include the bill of sale. $55 total cost. So, I'm going to do that.. then when I get THAT title, I'll get the car regged up in the state of AR. Thanks everybody ;)

swingdjted 29th August 2008 22:43

That's pretty nice that it didn't require the owner's sig.

protegechris 29th August 2008 23:21

Edit: Got a second email from them saying the owner would have to fill out that form.

Guess I'll have to call the PD in Portland, this is ridiculous.

swingdjted 30th August 2008 03:15

Yeah, it seemed a bit too good to be true.

protegechris 30th August 2008 03:21

No biggie. On a side note, since this is related..

WTF is up with insurance? I just bought a 1998 Mazda 626.. I'm paying it off to the owner.. but I can't insure it (with geico at least) unless I am the registered owner. O_o

I hate this crap. insurance = lame

swingdjted 30th August 2008 03:34

Yeah, unless you're paying it off through an official auto loan, they can't insure it to anyone other than the owner on record.

General Geoff 30th August 2008 22:11

That's BS. I've insured cars owned wholly and entirely by private citizens from out of state. I have Progressive btw.

The way the insurance rep explained it to me, "Anyone can put out an insurance plan on any vehicle, they just need the VIN and the license plate number."

swingdjted 30th August 2008 22:16

I use Progressive too. Who gets paid if something happens to the car in that case - the person that's paying the premiums or the owner?

protegechris 2nd September 2008 15:06

Hrmph. I just went by what geico told me in an email.

Quote:

We have received your request and apologize for any inconvenience. However, in order to add a vehicle to your policy, the vehicle must be registered and titled in your name within 30 days. If you will not be the owner of the 1998 Mazda 626 within 30 days, the owner would need to carry coverage on the vehicle and list you as the driver until you are the owner.

On a side note, the car I started this thread about.. person A *AND* person B will no longer answer my phone calls or emails, and the car has been sitting in my parking lot for a month now. I guess I'll have to contact the police in both of their home cities next :/ Having their names, addresses, and phone numbers will come in handy now.

heh, little things like that are what alerts oregonians to the non nativeness of out of staters, it's generally referred to as O-DOT as an unspoken rule, slightly off topic i know, just something you notice about someone not raised around here.

P.S. : it shouldn't matter unless you're a californian AND bitching about the cold, but we generally regard anyone from washington as a tax evader and asshole, mostly true as well.

swingdjted 2nd September 2008 23:07

O-DOT is the Ohio Department of Transportation gawddamnit!

The biggest problem with this whole situation is that from what I understand, you already paid the guy/gal for the car, and there's a chance that you'll lose the car and still not get the money back. Without notary public documentation, it may be difficult to prove that you paid for it.

Too-DAMN-Much 3rd September 2008 06:42

it's both  :blah:

DOT actually called me yesterday. She said she'd been checking into it, and if that previous owner was ducking me now, I need to fill out a request for replacement title, send it in with the $55 replacement fee ($5... in arkansas), and the original bill of sale, and she'll take care of me. Sweet. That's the last time I buy a car without title in hand, whether it's from out of state or not..

Phew!

You dumb bitch.
You not only spam but double it much like the fisting I hope a large gorilla gives you later tonight.

swingdjted 21st September 2008 04:24

Chev's getting soft.

He's allowing a period of non-gorilla-fist-rape between now and "later tonight", or does the elongated anticipation make it worse?

ElChevelle 21st September 2008 04:56

In the meantime, she was getting multi-gagged by Manchester United so I thought I'd throw in some time for their sake.
