I need some advice on titling a car..
I bought an older car from person A a little over a month ago.. in Arkansas. He drove it down here, and it started having problems.. so he didn't want to drive it back to Oregon.
He said he'd mail me the title when he got it from the friend he got the car from. He proceeded to tell me later on that the friend wouldn't give him the title. The friend is person B. I contacted person B after giving up on Person A. Person B, the owner that the car is STILL registered to, insists he gave person A the title to the car. Person B said that he did in fact give person A the car, and that he didn't care it was sold to me.. but that he wouldn't request a new title for me, even if I paid the fees.. because he didn't want to deal with it. What are my options here? The car is still currently (actively) registered in Oregon. Person A was a douche, person B is alright.. but he really just doesn't want to mess with it anymore, I suppose. Person B *and* Person A are Oregon residents. The car is registered in Oregon. The car is currently located in Arkansas (my parking lot, to be more specific), and that is the state in which I am a resident. yeah, i'm back. |

call the Oregon Department of Transportation and explain that the title has been lost. Give them the contact information for the last known owner of the vehicle (Person B). Be sure to have the VIN and license plate number of the vehicle handy when you call.
They should be able to straighten things out.

So should I explain the whole "title never transferred" situation to them? Or just that it has been lost?

Well, since person A never registered the car in his name, I cut him out of the scenario. Person B is going to give me a bill of sale from him to me (and then promptly said he didn't want to hear about the car again ahah).
Oregon DOT says I can request a replacement title be sent directly to me, without so much as the current owner's signature, if I include the bill of sale. $55 total cost. So, I'm going to do that.. then when I get THAT title, I'll get the car regged up in the state of AR. Thanks everybody

Edit: Got a second email from them saying the owner would have to fill out that form.
Guess I'll have to call the PD in Portland, this is ridiculous. yeah, i'm back. |

No biggie. On a side note, since this is related..
WTF is up with insurance? I just bought a 1998 Mazda 626.. I'm paying it off to the owner.. but I can't insure it (with geico at least) unless I am the registered owner. O_o I hate this crap. insurance = lame yeah, i'm back. |

Yeah, unless you're paying it off through an official auto loan, they can't insure it to anyone other than the owner on record.

That's BS. I've insured cars owned wholly and entirely by private citizens from out of state. I have Progressive btw.
The way the insurance rep explained it to me, "Anyone can put out an insurance plan on any vehicle, they just need the VIN and the license plate number."

I use Progressive too. Who gets paid if something happens to the car in that case - the person that's paying the premiums or the owner?

O-DOT is the Ohio Department of Transportation gawddamnit!
The biggest problem with this whole situation is that from what I understand, you already paid the guy/gal for the car, and there's a chance that you'll lose the car and still not get the money back. Without notary public documentation, it may be difficult to prove that you paid for it. Don't forget to live before you die.
