Drunk to stay warm defense works for DWI suspect

JACKSON, Mo. (AP) -- A southeast Missouri man has been acquitted of drunk driving after claiming that he drank alcohol to keep warm after -- but not before -- driving into a culvert.

The Southeast Missourian reports a jury acquitted Thomas Drummond of Jackson last week.
The accident happened in February. Defense attorney Stephen Wilson says it was a set of facts you don't see every day.

Drummond told the court he had been out with friends the night of the wreck. Driving home on an icy road he drove into a culvert. Drummond says he was not intoxicated while driving, but was by the time emergency workers arrived.

Wilson says Drummond was stranded in the cold weather for more than two hours.
