UK Licensing!
Is there any cheap way of going legit in the UK?? i know there is a joing MCPS and PRS Licence that is like 8% of income or something. but what if i'm not making any money?!?!?!
What can i do. I got a mail from MCPS saying that my site contains un licenced audio content... could i just take the embedded streaming players off the site to keep them quiet.... help! |

just remove all audio links from your site that relay your site users to copyrighted content.

is it ok to have a link that just says click here to listen in winamp or something, cos only since i put the embedded media player in have they started to mail me!

The way MCPS and PRS look at it is that they do not care where or by who the audio is hosted, but if you link to it from your site then you are providing the content. Whether or not this would stand up in court i don't know, but do you fancy finding out ?
The joint MCPS PRS license is very strict in that it limits you to 30 second samples of tunes and/or pre recorded broadcasts of live recordings or recordings of multiple tracks (i think it does anyway the wording of the licence is somwhat vague). It is also very expensive and is a fised amount of money with a limit on the amount of music you can use rather than a percentage of income. Please note as well that PRS/MCPS are only licensing the song and not the recording, just because you have a PRS/MCPS license does not neccesarrily mean that you can stream music you will also require a license from the copyright holder of the sound recording (usually the record label). The PPL is the equivilent of the PRS/MCPS for this but the only internet license they currently give out is a license for radio stations to "simulcast" their FM/AM broadcast over the internet, they do not supply an internet only license of any sort. |

Sounds all very complex but Would they really have the Ability and finances to take everyone In the Uk Broadcasting live radio to court?? I dont think they have - Bit like the Downloading Of Mp3 Files it would seem!!! Should they want to pick on me ill let ya know!! ill ceratinly put upa Fight LOL... oh well Happy Broadcasting LOL

can someone please tell me. i live in the uk. do i need any sort of licence to broadcast music over the internet using my internet connection as a server? i wont be making no money fron doing it.

Gareth Im in the Dark as Much as you are - I just hope and pray that if we are doing it as a hobby like i am that we dont have to pay anything - as i sed b4 I suppose its a bit like mp3 downloads no one gets charged for them do they!!

We at Selecta Radio have received the same email. As a result we are thinking of using Live365 instead since they organise licenses.
Either that or using a US hosted website under a .com address. I would be very interested to know if anyone has blatantly flouted this request for a license and what happened. We were quoted £2500/yr for mcps/prs LOEL license. This as you rightly pointed out doesnt entitle you to use PPL recordings which I think costs a further £500/yr but as you said is not an internet only license. Do you think if we removed the stream links from the site and instead just gave them out by chatroom or email or something PRS would be happier. Its such a shame really the USA have just been through this crap and come out with the small webcasters settlement agreement which was hardly ideal. Any thoughts? |
