just a simple example: when I run the program, only banners in german language are shown (and indeed I´m german). But the software got no language based setup... !!

Not really, the key phrase that they use is "without your consent" by installing their program, you are supposed to read the terms and conditions, in here it mentions the programs, you then "agree" to install them on your system.

they tell you a number of times that they are installing these programs

"spyware" doesn't have a strict definition- they can claim that their "adware" is not "spyware" because it monitors your activity in order to "send you relevant offers/advertisments[spam]"...

they can twist their actions around to make them seem alright, but the bottom like is KaZaA contains spyware.

Cydoor is Kazaa's spyware portion of the program, which for example will send you only German adds if your computer is configured for the german country and language setting codes.

Yarse! That is correct. It's bloody annoying (Gator that is)!
Why do they need to spy on people!? It's not as if people listen or bother buying stuff from the annoying ad's! Screw they spyware i have - i have Zone Alarm Pro so no annoying popups most of the time!

You know all those programs that are free? Paid for by advertising: that's why the ads are there. Nowadays, marketing people are realising that ads get ignored so much, so there are more and more pay-for services, even MSN hotmail.

The blank popups occur when the page/window didn't load properly.
