Principal chokehold's student over dress code

It started over a dress code violation, hardly reason enough to throw away an academic career and certainly no reason to be charged with a felony.

"I have goals I want to achieve and this is stopping that," says 17-year old Sabrina Herndon.
Herndon was wearing a jacket and strapless top and was changing in the girl's locker room at Palm Beach Gardens High School.

A teacher noticed the strapless top which is a dress code violation. Herndon says with the jacket though, the top is within dress code.

A male assistant principal then entered the girl's locker room, and within minutes Herndon was in a choke hold.

"He came behind me and he picked me up with it and he tried to carry me out of the locker room and then I fell, then he came from under me and choked me a second time."

The question of course is what prompted the assistant principal to resort to such tactics? Herndon says nothing and says she has witnesses to back her up.

"I did nothing wrong to where he had to use physical force. I had no weapons, I made no threats or anything to him."

The school district also has witnesses who say the assistant principal was justified to use force.

They're not telling us specifically what happened because Herndon is a juvenile. They are saying her behavior warranted felony battery charges.

Herndon says she doesn't understand why she's the criminal, when she's the one who was choked.

"It's his word against mine and mine is being overlooked." Herndon is now facing expulsion and her college career is in question. A high price to pay for a fashion faux pas.

"For the whole thing to go out of proportion over a dress code issue is ridiculous," she says.

A Palm Beach Gardens High student recommended for expulsion has accused her assistant principal of choking her during a skirmish over a dress code violation, an allegation that school district officials describe as "totally untrue."

According to a school police report detailing the Nov. 28 incident, assistant principal Mike Chamberlin said gym teacher Cheryl Green called him to the girls' locker room after 17-year-old senior Sabrina Herndon refused to comply with school dress code policies.

Chamberlin said he was trying to get Herndon to leave the locker area and, when he placed a right hand on her arm to escort her out, she hit him in the chest, according to the report.

The high school senior explained the incident differently to police, stating that Chamberlin pulled her by the shirt and asked her to leave, but when she refused, Chamberlin grabbed her by the arms, the report states.

Herndon said she pushed Chamberlin off but was choked when the 38-year-old assistant principal placed her against a wall, according to the report.

Chamberlin and the gym teacher deny Herndon was choked, the report states.

Chamberlin called the school police, who arrived to find him physically restraining the student, the report states.

The girl admits she was wearing a strapless top, which violates the school's code, but said she was wearing a jacket over it.

When a student violates the dress code, they are usually given a pink slip and sent to the school's media center to trade in their clothes for school-issued apparel, Herndon said.

During the initial argument, Herndon said she called her mother on her cell phone but Chamberlin refused to speak to her.

"It didn't have to go this far for a simple dress code," Herndon said Thursday, adding that many similarly dressed girls weren't confronted by administrators.

The student was suspended from school, recommended for expulsion and instructed to attend an alternative school for students with discipline problems until the Palm Beach County School Board decides whether she should be expelled.

District officials also referred charges of assaulting a school board employee, a felony offense, to the state attorney's office, district spokesman Nat Harrington said.

Herndon's attorney Barbara Briggs said she will fight the expulsion but said the family hasn't decided whether to pursue a lawsuit against Chamberlin or the school district.

"She'd just like to drop the expulsion and get back to school so she can participate in her last semester of high school," Briggs said.

Herndon was suspended earlier this school year for a different dress code violation, Briggs said.

Chamberlin and Palm Beach Gardens principal Jonathan Prince refused to comment on the incident Thursday, citing student confidentiality concerns.

Both administrators referred questions to Harrington who said Thursday that Herndon's allegations are "totally untrue."

"There were several witnesses who attest the allegations are totally untrue," said Harrington, adding that Chamberlin is considered to be "one of the most gentle and caring administrators in the district."

The incident has drawn the attention of the Advancement Project, a Washington D.C.-based civil rights group that released a statement to local media arguing the incident is "consistent with the trend in Florida to over-use suspensions, expulsions, and arrests that result in the needless denial of a quality education."

The group released a report last spring based on public hearings in five counties, including Palm Beach County, that criticized Florida schools for increasingly turning to police for school discipline.

"What happened to Sabrina is something we've heard about happening many times before," said Monique Dixon, a senior attorney with the organization.

Harrington described the statement as "an unfortunate mischaracterization of the incident."

You know, there is something just out of place here. If she did not want to comply with the dress code, why not just go to another school?
Frankly, the treatment she allegedly received was far less harsh than what would have happened when I was in such institutions.

I am so important I feel the need to let it be known like a liberal discovering the internets for the first time. Uh hur hur hur. I also wash myself with a rag on a stick.

I've watched tons of those girls fighting video clips on youtube and grouper. The asst. principal was probably fighting for his life.

If you live in California, what you say may hold true (i.e. democratic, free society). But the rest of America is like a rotten stinking hole still living in the old ages. The President is not doing anything about it either.

Besides, if you really want freedom, there's only one real option: move to New Hampshire.

I mean, that's just a silly talking point attempt at a bad joke from 30 years ago when talking about the San Francisco hippies or Marin county (also very monied and conservative) hot tub parties. California is actually quite conservative -- we have our own flyover country in the great central valley.

I wonder what she looks like

Observations:
1. has violated the dress code at least once before
2. knew the shirt she was wearing would violate the dress code, so she also wore a coat
3. the idiot coach or whatever overreacted
4. a man should NEVER enter the girls locker room
5. whatever happened, happened and the whole thing has been blown out of proportion
6. the slut is lying about being choked

If she wins, she will abuse the system for the rest of her life. If she loses, she gets screwed by the system for the rest of her life. They all just need to admid that they handled things badly, learn from it, and let it go. Let the girl finish school, expelling her is not in her best interest. School officials should do what is in the best interest of the STUDENT. She'll have to deal with real life soon enough.

I would be more against the admin if I had ever met one that didn't have this militaristic sort of predisposition that would leave me to believe they are more than capable of choking someone over a simple dresscode violation.
