Broadcasting from Australia - Legalities?

Hi,

I'm guessing that the CRAP, oops, CARP ruling doesn't affect broadcasters based outside the US (due to the different licencing bodies outside the US). I'm just curious as to the legality of running a streaming internet radio broadcast from Australia.

Would I be required to purchase some sort of licence from someone like APRA or a similar organisation? Might I be better off using someone like Live365 and paying my USD$5 per month for it? I'd rather not give those bastards at the RIAA anything if I can help it, but what can you do.

Any help or guidance is appreciated.

Hi,

To be truely "legal" in Australia, one does need a Broadcast licence from APRA, and depending on what you stream (user interactive or straight playlist) they charge you a minimum monthly ($500-600) or a percentage of Gross Takings per month (which ever is higher). This is based on one stream. Unsure still if they see a stream at different bandwidths the same or different...

Check their website out at APRA for full details and download the application form...

No probs - but remember in Australia, going via Live365 does not make you "legal" - you still need to be licensed.

Not neccessarily, Live365 assumes legal ownership of the stream if you are using one of thier personal accounts.

I was under the impression that because Live365 is broadcast from servers located in the US, that the radio stream would be considered to be under US jurisdiction - despite the fact that it is being programmed by me in Australia. This would mean that the stream would have to be licenced under CARP and not APRA. Or am I mistaken?

well in accordance to your agreement with Live365 you cannot make legal decisions about their service (which this would be). Unless Australia has some querky law. If I were you I wouldn't worry about it, because as long as you follow the Live365 TOS to the letter who's to know.
