Hello,

Is it not illegal to stream copyrighted material on your radio station? What do all the other about 4,000 people who stream music here do?

Streaming radio is perfectly legal if you follow streaming rules and pay royalties.

And it's lots of fun too.

What exactly are the streaming rules? Do I have the ask the artist for permission before streaming their music?

A: The rules are different depending on the broadcast origination.

Summary: If you play copyrighted material, then you need to pay.

Q: Do I have the ask the artist for permission before streaming their music?
A: If you do and get a waiver from the licensing/royalty fees, then you should be good to go.

A: The potential exists. The risks (and penalties) increase with the volume of listeners your stream can support.

Q: What do you do, Festerhead?
A: I pay licensing/royalties through an Audiorealm subscription stream and Live365.

Which one do you use for a music license and whihc one do you use to stream your music? Does your music license allow you to put music downloads on your website?

Independant Free Releases

To avoid the whole "Fee" mess, simply play ONLY
independant artist free mp3 releases from any
of the many free mp3 download sites. Such music is
released with the hope that radio stations will
play and promote it free of charge. Any limitations
that any independant artist wishes to impose upon
a free release must be expressly implied, and
otherwise, such is free, without limitations,
and the artist retains the right to set limits.

The matter is a simple one. Do not play music
by the major labels if you wish to avoid paying
their fees, and only play free independant releases
to freely promote independant artists who need your
help to compete with the labels.

There are no fees to streaming via shoutcast.
There are different fees in different locations to stream
major record cartel music.

There are no fees to stream independant artist music,
and in particular, free releases by independant artists.

What about sites that offer free music downloads such as www.puroeuro.com and www.euroadrenaline.com? Must I ask permission from these websites before streaming their music downloads?

If it's copyrighted and you want to stream it royalty free, then probably.

All it takes is an email.
