Not Guilty?
Why is it that the legal system will not find a person innocent and only 'not guilty'? Isn't he already innocent unless proven guilty?

He's innocent until proven guilty. The trial is about proving him guilty or not, if they don't, he's "not guilty".

Yeah well in Canada, proof of innocence falls on the hands of the defence (for the most part), not the prosecutor's as is the case in the United States.

I understand what your saying but this is not a case of moral innocence. If we truly are "innocent until proven guilty", why should the accused be punished simply because he was wrongfully accused? He turns into the true victim of the crim where the guilty is in reality the state. A person's reputation can be severly tarnished by any charges brought against him and even when it is found that there was no wrongdong, we insult his integrity by refusing to say what we know to be true - that he is innocent.

"Innocent until proven guilty" isn't literal, it means like blueprint said, the burden of proof is on the prosecutors. In some countries, you're "guilty until proven innocent." The phrase makes that distinction, but doesn't mean that everyone who isn't guilty is innocent. They're just words, man. If you're going to say that anyone who is not guilty is innocent by definition, then what difference does it make which is said?
