License
Is it true that to broadcast music over shoutcast you need a license?
If it is what is the website to obtain one of these licenses? Chris |

Yes, you need licensing to webcast copyrighted materials. Royalties, ya know
![]() Hit the licensing link in my signature and you'll find what you need.

Yes, you'll need licensing with either SWCast or LoudCity - I'm not sure if LoudCity are accepting new customers again yet, but SWCast are usually cheaper anyway.

I have had a great experience with loudcity.net
![]() http://www.loudcity.net/ Haven't tried swcast, but I have heard that they are slow to respond and that they were having problems with their licensing. Again, I haven't worked with them, so this is just what I have read on this forum. They could be great, I really don't know firsthand. |

Doesn't it depend on where the broadcast server is located? I forget the exact details on that. I'm in the US and my server is in the US, so obviously I have to pay the fees here, but what if the broadcaster is in another country and they are using a broadcast server in the US, would they be responsible for payments in the US?

Websites typically exploit the music-recordings -- notwithstanding the physical location of any servers involved in the process of delivering the broadcast transmission -- thus, it is the Website owner that is responsible for ensuring the broadcast transmission made available therein is compliant. Additionally, a broadcast transmission that is transmitted outside of one's country of origin, may in fact constitute separate performance(s) within each and every respective jurisdiction into which it is received, thus requiring the Website owner to secure a performance license from every respective performing rights organization in accordance with applicable copyright statutes. I would advise speaking with an attorney for specific clarification. Yeah, I know the Website owner is responsible, but I had read somewhere that the actual licenses that the owner needs to acquire depend on where the stream is being hosted from. I know the stream host itself is not responsible.
