Copyright Laws in a nutshell

i'm interested in broadcasting classic rock music like pink floyd etc. Can anyone give me a quick low down of how much this would cost me and can I just broadcast it or do i need to buy expensive licensing agreements.

Even some artists that are on the internet allow you to download their music, but never stream it. Funny how everyone wants a peice of the pie.

Loudcity or a good lawyer that knows the local, state and federal laws and is good with the MPAA or RIAA it another consideration to keep you our of hot water.

The big boys like .977 possibly pay $1000nd a month to play 80s music , 20 year old music and still have to pay someone to play it.

*Sigh. Anyone want to hear my cat play on my midi keyboard or should I apply for copyright. sorry I couldnt resist.

I looked into this in great detail just recently.

The Digital Millenium Copyright Act provides for a statutory license to webcast copyright music. It is, so to speak, a compulsory license.

You must file Notice of Intent with the copyright office and a $20 filing fee, and you are "free" to begin streaming whatever you like.

"Free", that is, except that you must thereupon pay royalties to SoundExchange. SoundExchange is an agency of RIAA, designated by Congress as a "collective" (thank you Mr. Trotsky) and empowered to collect these royalties.

You must pay $.000762 per performance. A performance is one song to one listener. One song, ten listeners = 10 performances.

You must pay a minimum of $500 per year per channel. If your performance royalties exceed $500, you must pay whichever is greater.

Whatever you have permission to play, granted by the copyright holder, is exempt from royalties. Everything else is copyright, and you must pay. Or else.

ASCAP licensing looks a little cheaper at first glance, but that might not be true. They have a minimum of $288 per year, and you can play a lot more performances before you owe them $500 on straight royalties...however, they also want a cut of the action, such as ad revenues and etcetera.

They want the right to look at your books. If you don't make a profit, they are undaunted - they want a percentage of your expenses, then!

The big boys got there before we did, sorry, fellers.
