SHOUTcast, NULLsoft and AOL not responding

Hello, my friends!

I want to use the SHOUTcast's software for my business. Do I need permission from the SHOUTcast (NULLsoft or AOL)? I wrote several letters to the leadership of these companies, but received no response. How and from whom can I get a work permit?

as long as you use the SHOUTcast tools in the correct manner as per the EULA then there's no need to get explicit permission for either personal or business use plus the downloads wouldn't be available to everyone if there were limitations, etc.

your concern should be with licensing of any music played with the relevant bodies in the country you're working in which is down to you to sort out or have sorted out for you depending on how you've got your hosting plan setup, etc.

I am always happy to talk with you! I am 20 years served in the army, and I would take you to explore! But this is a strange problem that prevents your firm's and my business. This - the license, but it is - not the same license.

I speak in English is bad, and perhaps incorrectly expressed. But the problem is not with copyright on musical works or something like that. I know that it is solved in my country, and such a treaty has already been discussed.

The problem with the SHOUTcast’s software.

Section 13. License To Use the SHOUTcast Radio (http://www.shoutcast.com/tos):
We grant you a personal, non-exclusive, non-transferable, limited and revocable license to use SHOUTcast Radio subject to these Terms. You may not use SHOUTcast Radio in a manner that exceeds the rights granted for your use of SHOUTcast Radio and its Content. Without limitation of the foregoing, you may not frame any portion of SHOUTcast Radio or Content, or reproduce, record, reprint, copy, store, publicly display, broadcast, transmit, modify, translate, port, publish, sublicense, assign, transfer, sell, loan, make derivative works or otherwise distribute the Content without our prior written consent. You may not circumvent any mechanisms for preventing the unauthorized reproduction or distribution of the Content or SHOUTcast Radio’s applications, software or services. Your license terminates immediately upon cancellation or termination of your account or if we believe you are in violation of these Terms.

In my country there are many organizations that want to have their own broadcasting stations, but do not have to do specialists. I intend to open an organization that would provide services for the creation of broadcast stations. For these purposes, I intended to use the SHOUTcast’s software. But I am no one wants to answer, how can I get written permission. I am willing to pay for the software, I'm willing to pay for its support. I am ready to discuss all issues and problems.
I am ready to create a joint venture or take in a representative co-founders of the firm. We can all discuss. But I was no answer. Time passes and we lose money. I will be forced to turn to another firm.

Shoutcast Radio = The YP (directory) and it's data
You need a license from AOL and an API key to use that.

Shoutcast Server = Free
You do not need a license or permission from AOL to use Shoutcast as a platform for streaming (The server executables etc)

"Shoutcast Server = Free" for my personal needs, but not for commercial use.

I need a written contract or a license or certificate, which would have stated that I have the right to use the SHOUTcast’s software to create broadcast stations.

aol has granted world wide royalty free usage of the shoutcast tools.

You cannot distribute them. thats it.

There are no restrictions on you.

You will go to your clients and install shoutcast server downloaded from winamp .com.

That is what this means.

I expect AOL will never contact you.

Ok, I am no lawyer, but what Im guessing how this will pan out is this....

1) You will want to create the agreement that the broadcaster of the server takes ownership and accountability of the server.

This will cover your bases on all fronts, as it implies that they are the owners of the server, and you are mearly charging for bandwidth and server space. This way, your not charging for the shoutcast server itself.

2) owner takes responsibility of all content on the server.

This is a no brainer. You dont want to be hunted down because a broadcaster talked about terrorism/murder/drug trafficking/human trafficing ect. Broadcaster needs to be liable for copyright royalties and all content within the legal means of his control.

Serge Clause: i will try to get some sort of response (though there's no guarantee i'll get anything) but i believe from reading things and what has been said by others, there's little need for anyone at AOL making some sort of letter (or whatever is needed) to cover things.

though i'll add that the parts you highlighted are relating to primarily doing things with the audio data and directory listing. as for the part about the files of the tools themselves, the tools are provided for free and as-is, with support of sorts provided if there is a technical issue with them (at the moment). and tbh, i think you're possibly over-reading things, most of the eula is to cover Aol/Nullsoft from people being stupid with things and trying to pass on streams as their own from the directory when they are not.

All:

We still continue to confuse the two different resolutions:
1. License to broadcast copyright works. It can be called differently.
2. Permission to copy, distribute and install SHOUTcast’s software (specifically – sv_serv, sc_trans, winamp, dnas, dsp and possibly different). All the nuances we can discuss.

License under paragraph 1 in my country gives the organization supervising the observance of copyright. But I can enter into an agreement (for example, with the singer - directly).

I'm interested in item 2. That SHOUTcast, AOL, NULLsoft or other firms then do not accused me that I'm spreading their software illegally and did not show me the claim.

Microsoft, Autodesk, Borland and others have long been distributing its products through distributors. Sooner or later this problem will arise, and to SHOUTcast, AOL and NULLsoft. Looks like she has already begun. Delaying a solution to this problem, SHOUTcast, AOL, NULLsoft may lose customers.
