RIAA sues family with no computer or internet access

So, you don’t own a computer and don’t have internet access. Why should you care who or what the RIAA (Recording Industry Association of America) is? After reading this, you may think twice about that.

In the RIAA’s latest lawsuit extravaganza, they have managed to sue a family with no computer and no internet access. Carma Walls is the latest victim of the RIAA who’s subpoena states:

"Plaintiffs are informed and believe that Defendant, without the permission or consent of Plaintiffs, has used, and continues to use, an online media distribution system to download the copyrighted recordings, to distribute the copyrighted recordings to the public, and/or to make the copyrighted recordings available for distribution to others'."

What’s interesting here is that the subpoena says "has used, and continues to use." However, as stated before the Walls don’t even own a computer or have any internet access. Are you really surprised? How can they “continue to use” something they do not have (and have never had) in their possession.

Walls also stated that his family has lived at their current address less than a year. The prior occupants could have had a computer and internet access. The prior family could also be the at fault party. However, the RIAA is refusing to even consider this a possibility and insists that Carma Walls infringed eight copyrights.

I pretty glad the British equivalent of the RIAA has been fairly lenient with litigation, so far seemingly only targeting big uploaders. Hope it stays that way.

Way I've seen it, the BPI have mainly been working on areas of law for now, so don't count on their being passive.

The RIAA has become a virtual lawsuit machine, and controversy is never far behind. Most recently, a lawsuit recipient from Rockmart, Georgia claimed to not even own a computer, creating another possible public relations spill. Carma Walls told the Rockmart Journal over the weekend that she briefly owned a computer, but got rid of it about one year ago. Meanwhile, the RIAA defended its actions, and disavowed the report. "The defendant, in a conversation with our settlement experts, and in response to our initial letter said that her family had a computer and used it to listen to music," a spokesperson told Digital Music News on Monday.

The incident could blow over, though the RIAA has become somewhat of a magnet for situations like these. Earlier this month, MIT student and RIAA lawsuit recipient Cassi Hunt claimed that the RIAA actually advised her to drop out of school in order to meet an infringement settlement fine. "In fact, the RIAA has been known to suggest that students drop out of college or go to community college in order to be able to afford settlements," Hunt reported an RIAA representative as saying. The validity of that claim remains unclear, though the RIAA told Digital Music News that it does not advise individuals on how to make payments. Regardless, the negative publicity from these and other situations could be harming the overall effectiveness of the anti-piracy campaign, and earlier incidences involving a teenager and a deceased recipient have not helped. The group has issued over 18,000 lawsuits since September, 2003.

I wonder how many of those 18,000 lawsuits have resulted in much if any financial gain while at the same time costing an assload in attorney fees.

problem is: it does not matter. The RIAA clearly has their heads so far up the government's ass that they can't see daylight anymore. The problem is, the government had their head so far up the RIAAs ass that they can't see daylight either.

This orginization is seriously becoming more and more like Hitler with respect to "my way, or fuck off". They do not care what they do, how they do it, or what it does to the people that they are protecting. The clearly do not give a fuck about the artists whose interests they are acting on because these "artists" have yet to see one fucking red cent from these lawsuits.

And, yes, the lawsuits have enough gain in the RIAAs mind. I forgot the source that I read it in (well over a year or two now), but the only thing the RIAA is doing with the money is using the profits to fund more lawsitus.

Fucking bastards.

Well, that's what I meant. It is probably the reason not one artist, band or composer is a member of the RIAA. The RIAA does not help the artists - it helps the people who are fucking the artists and ripping them off.

Theory: The Winamp forums is like Usenet.

Assertation: Usenet threads go on past "Godwin's law" invokations anyway, they're just rendered pointless.

Observation: This thread.

...

The evidence is mounting.
